1. ACCEPTANCE OF TERMS
Welcome to Microuse. We provide our service to you subject to the following terms of service.
By accessing, browsing and completing the registration process and using this Web site "SITE", you accept that you have read, understood, and agreed to comply with these terms of service "TERMS" and to comply with all applicable terms and conditions, which Microuse in its own discretion may change from time to time. In consideration of your use, we will inform you by posting the changes to the terms on our "SITE". If you disagree with our change you must discontinue or terminate your registration, as the change shall be effective immediately on posting. Your continuation will signify your acceptance to the new terms unless proven otherwise. This terms of agreement may not be modified and if modified it will be in writing and where possible be signed by authorized Microuse officer. If you do not agree to these Terms, please do not use this Web site.

2. YOUR REGISTRATION OBLIGATIONS
This include, any information or any other materials you provide to us during registration when you open a new account, in consideration of your use of the Service, you are personally responsible for your information. As we act as intermediary between the buyer and the seller. You agree to provide true, accurate, current and complete information about yourself as prompted/demanded by the Service's registration. (As the information is the "Registration Data" )

     NOTE: Maintain and promptly update your Registration information to keep it true, accurate, current and complete. If you provide any baseless information that is untrue,  inaccurate or  incomplete, Microuse has the right to terminate or suspend your account indefinitely and refuse any future use of it's website. The complete terms of our Privacy Statement are part of this Agreement so you should read it. On occasion, the Microuse may ask you for personal information such as your name, social security number or address. We do this when you register for products or services that require registration or subscription. The Microuse needs to collect this information for tracking, verifying and compliance with Microuse policies. It may also be needed for purposes of compliance with federal, provincial and local laws and/or for editorial and feedback solicitation purposes. When we intend to use your personal information, we tell you up front. This way you can decide whether you want to give us the information or not.

3. USERNAME, PASSWORD AND SECURITY
You will select a  password and username (email address), upon starting the registration process .You are solely responsible for:

  • Maintaining the confidentiality of the password and username (your account),
  • And you are fully responsible for all activity that occur or/and happen under your password and username.
  • You agree to notify Microuse of any unauthorized use or access of your account or any other breach of security, and  ensure you sign out at the end of session.
  • You agree to open one account only.
Microuse will not and cannot be responsible/liable for any loss or damage occurring due to failure to comply with terms of service.
NOTE: Do not disclose your password to any other third party or use your password irrelevantly. Microuse will not be responsible to any mishap arising from unauthorized use of your account.

4. RULES ON USE OF POLICY, INFORMATION AND MEMBER CONDUCT
Microuse adopted use of policy, which you agreed on registration, to ensure that service is used in a lawful, appropriate ways and manners. Microuse reserve the right to investigate any misuse of its service and to protect its service.
The following is strictly prohibited on the service information:
  1. Any obscene or material containing child pornography or any other pornographic image or message.
  2. Trade any material containing viruses, Trojan horses, worm, time bomb or any other computer programming routines that can intentionally damage, basically interfere with surreptitiously intercept or expropriate damage any system, data or personal information.
  3. Sale of stolen good or fraudulent activity  
  4. Include (infringe) any third party copyright, trademark, trade secret,  patent or any public or private right or any other propriety right.
  5. Unlawful threatening or harassing, defamatory or trade libelous.
  6. Do not use the market place in connection with junk letters, spamming  or duplicative, collect other e-mail address or information  without their  prior notice and permission, create false email address.
  7.  Include description of good and service or link directly or indirectly to such good or service 
  8. Conceal the identity of the sender.
NOTE: Violation of Microuse policy will not be tolerated and shall result in termination of buyer or the seller account without prior notice. AGAIN Microuse will not be held responsible, or be liable in any way for any content, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as  a result of the use of any content traded via  Microuse or its employee or any other related party to Microuse And hence, Microuse will terminate by removing your registration if and when you violate its term's of service. You acknowledge and accept Microuse right to preserve or disclose the content of your registration if required by the law. Or in belief that such preservation or disclosure is reasonably necessary to comply with legal process, enforce terms of service, respond to claim  that any content violate the right of third party or protect the rights, property, or personal safety of Microuse its user and the public.

5. PROHIBITED TRANSACTION AND SPAM
You will not post item prohibited on Microuse list of items incorporated herein by reference that may change time to time. Or trade any item that could cause use to violate any applicable laws. Microuse in its sole discretion reserve the right to limit or terminate  your service  and account and without prior notice to you if and when you violate the terms of service. Microuse will not be responsible for your action either its employee or officials will be responsible.

6. INDEMNITY
You agree to hold and indemnify Microuse, our subsidiaries, affiliates, officers, directors, agent, researchers and employee harmless  from any claim or demand from any third party claim, losses, damages demand including reasonable attorneys' fees due to or arising out of content you submit post or transmit through the service, your use of the service, your content to the service, your violation to the terms of service or your violation of any rights of another.

7. QUALIFICATION
Microuse market place is available to individual/company that can form legally binding contracts under applicable law. Therefore you must be at least 18 years of age to register at Microuse.

8. YOUR INFORMATION AND PRIVACY
WHAT IS "PERSONALLY IDENTIFYING INFORMATION"?
"Personally identifying information" is information that can be explicitly used to identify and/or contact you as an individual. This includes information like your real name, e-mail address, mailing address, phone number, credit card number, etc. Information that, by itself, cannot be explicitly linked with your "real" identity is not considered personally identifying. Personally identifying information that you provide  to the Microuse network or site will not be made available to a third party without prior permission from you. NOTE: When you voluntarily disclose your information in Microuse market place your information is collected and disseminated to buyer or seller and may be used by others. While Microuse does not share your information with the third parties not related to Microuse, therefore you may not receive unsolicited message from other parties if you post personal information online that is accessible to the public. Microuse network may aggregate information about our customer available to third parties for advertising and other purpose. Information that identifies you  will be kept strictly confidential.

Microuse is not responsible for the unauthorized disclosure of your information which  you choose to provide to another party or website. It will be subject to their private policies if you purchase good or service online from a merchant you found while searching Microuse.

9. FEES
Joining Microuse and the use of  web site are free. Microuse reserve the right to apply fees or charges in the event that members request service beyond the scope of the market place basic services.

10. PAYMENT METHODS
Payment options available at Microuse are as follows: credit card  or bank transfers. By using credit card for your payment you assert and represent that you are the authorized card holder of the card, bound by the terms and conditions of the card issuer, with full authority to create a binding contract for the sale.

11. DISPUTES OR CLAIM
In the event that a dispute or claim arises between one or more Microuse community members, you release Microuse (and our agents and employees) from any claims, demands and damages (actual and consequential) of every kind and nature arising out of or in any way connected with such disputes.

12. SHIPPING
THE BUYER AND/OR THE SELLER ARE SOLE RESPONSIBLE FOR SHIPPING. MICROUSE SHALL NOT BY ANY CONDITION BE RESPONSIBLE  FOR THE DAMAGES OR LOSS OCCURRED DURING SHIPPING BY THE THIRD PARTY.

13. MODIFICATIONS TO SERVICE
Microuse reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Microuse shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

14. LINKS AND ADVERTISEMENT
Microuse may feature in its site or e-mail communication to you,  links to a third party website, which may appear in form of text link advertisement, banner button  or otherwise. The goods and service available through these links are offered by independents corporation that are not affiliated in any  way with Microuse. Microuse makes no representation as to the quality, fitness workmanship value appropriateness or reliability of the merchandise available or the solvency or financial viability of advertiser. Microuse will not reimburse or indemnify you for any losses  you may incur as a  result of transaction with Microuse  Advertisers and users are advised to use discretion in selecting companies to do business with on line.

15. NOTICE
Unless explicitly stated otherwise, any notices shall be given to you by your e-mail address you provide to Microuse during registration, or any other address that specify your easy reach. Notice shall be deemed replied within 24 hours after you sent e-mail not unless the sending party is notified that e-mail is invalid. Alternatively we may give you notice by certified form of communication that we deem is secure and available to you. IN SUCH CASE WE MAY DELAY YOUR REPLY ACCORDING TO THE FORM AND THE TIME TAKEN FROM THE TIME WE SEND AND THE TIME TO REACH TO YOU.

16. INTERNATIONAL USER
The Microuse web site can be accessed  from all the country around the world and may contain reference to product, service and programs out of reach within your country due to government laws restricting such good, service or program trade to be carried in your country. Again the distance between the seller and the buyer may hinder the market place. So we recommend that you carry the business according to the stipulated reasons in mind as Microuse and its employees will not be responsible in case of damage or case arising  in regard to the reasons above. Microuse guarantee to  protect you and all the transaction you make will be safe so that you never have to worry about your credit card safety.

17. AGENCY  IS NOT ALLOWED
You and Microuse are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

18. FORCE OF LAW
Microuse shall not be liable to you for delays, failures or ignorance in performance resulting from causes beyond our reasonable control  or knowledge including labors dispute or disturbance, material shortage or rationing, strike (riot), war government regulation, communication or utility failures or casualties.

19. THE LICENSE
You  grant to us the non-exclusive, worldwide, perpetual, irrevocable, royalty-free right (right to sub-license ) to use, reproduce, adapt, publish, translate, create derivative work from, modify, distribute, perform and display [in whole or in  part] your information, and/or to put to incorporate your information in any form or in other work, media or technology known or to be developed.

20. BREACH
If we happen to know that by any case whether by mistake or lack of knowledge you breach this terms of agreement, and we are unable to verify any information you provide to us, we will immediately warn, suspend temporarily or indefinitely terminate your membership by canceling the information you give to us, or  registration information on Microuse.

21. STORAGE AND USE
You agree that Microuse may establish a rule concerning use of service without limitation on the maximum number of the days that e-mail or any other content on the Microuse site. The maximum number of e-mail message sent to or received by an account on the service. The maximum disk space allotted to you by Microuse server on your behalf, number of time or duration when you can access your service within Microuse service in a given period of time. Microuse will not be held responsible or liable for the deletion or failure to store your message or content on Microuse service. You agree that Microuse  reserve the right to change the practice and limit at any time in its own discretion without notice.

22. LIMITATIONS AND LIABILITY
You expressly understand and agree that Microuse shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damage, including but not limited to, damage, for loss of profits, goodwill, use of data, or other intangible losses (even if Microuse has been advised of the possibility of such damage) resulting from;

  •  The inability to use the marketplace.
  •  The cost of procurement of substitute goods and services resulting from any goods, data, information, or service purchase or obtained or message received or transaction entered into through or from the market place.
  • Unauthorized access to or alteration of your transmission of data.
  •  Statement of any third party  on the market place.
  •  Any other matter relating to the market place.
23. TERMINATION
You agree that Microuse, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Marketplace, and remove and discard Your Information within the Marketplace for any reason. Microuse may also, in its sole discretion and at any time, discontinue providing the service, or any part thereof, with or without notice. You agree that any termination of your access to the Marketplace under any provision of this Agreement may be effected without prior notice, and acknowledge and agree that Microuse may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Marketplace. Further, you agree that Microuse shall not be liable to you or any third party for any termination of your access to the Marketplace.

24. SALE TAX
State and local sales taxes will be charged on purchases of taxable merchandise based on the destination of the  good or service, and the government revenue.

25. LEGAL COMPLIANCE
You shall comply with all applicable laws, directives, statutes, ordinances and regulations regarding your use of the Marketplace: listing, purchase and sale of items, including, but not limited to, complying with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

26. ADVERTISING AND  FINANCIAL SERVICE
Your correspondence or business dealings with or participation in promotions of advertisers found on or through the Marketplace, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Microuse shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Marketplace.

27. THE MARKET IS " AS IT IS"
Since Microuse cannot anticipate, or foresee technical or other difficulties as we strive to make your visit to the site pleasant and free of any trouble. We for this reason, understand that  your use of the Microuse is at your own risk as this may lead to loss of data or information concerning Microuse market place thus creating interruption. Thus, Microuse disclaim all warranties of any kind and neither its employee nor officials will be responsible. No warranties that the market will meet your requirement, be interrupted, free of error, timely or secure. The service provided by Microuse or from third party will be accurate reliable or free of error. Neither the quality of the product, service, information, or material purchased or obtained by you through the marketplace will meet your need as expected or anticipated. Any material purchased or obtained through Microuse is at your own risk and discretion and you will be responsible solely for damage to your computer system or loss of data resulting from downloading of any such material. No advice or information oral or written obtained from Microuse by you shall create warranty not in the agreement.

28. NO TRADE MANIPULATION
You agree not to use a secondary account or third party to manipulate the outcome of a negotiation with a seller, buyer and/or Microuse or another trader.

29. NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

30. MISCELLANEOUS
You have thoroughly read and understand and agree that your use of Microuse is at your own risk and disclaim any warranties of any kind express or implied. The agreement regards the entire agreement between you and Microuse The law shall be governed by the laws of the government without any conflict or discrimination based on anything. The measure will be taken immediately upon breach by you or others. If any provision of this agreement is held invalid or unenforceable we shall struck such provision and enforce the remaining.
